Procedural law and dismissal in collective labor agreements in Ecuador

Labor relations disputes often occur between workers and employers or between labor organizations and employers' organizations. The methodology used to carry out the study was a standard research method that aims to find solutions to legal problems. The approach to the problem used is statutory, conceptual approach and case approaches. The legal process is carried out by examining all laws and regulations related to the legal problem being handled. This approach is taken to find the ratio legis and the ontological basis for the birth of the law. Meanwhile, the conceptual approach is based on the visions and doctrines developed in the science of law. Finally, the research offers two concepts of procedural law on the implementation of collective agreements. First, the court may not accept a claim for disputes that have been resolved through a cooperative agreement. The Panel of Judges is enough to deliberate and only determine with a single judge that the case has been resolved and choose the order of execution.
