Notarial legality control: deficiencies due to hidden vehicle liens in Ecuador. Case study
Abstract
This study aimed to analyze the responsibility and role of the notary public in verifying information from the National Transit Agency (ANT), particularly in cases involving the irregular lifting of vehicle liens. The approach was qualitative and documentary, supported by the analysis of a court ruling and a review of legal norms, doctrines, and institutional sources. The methodology employed was based on analytical and comparative interpretation, with the aim of examining notarial procedures and the shortcomings in the ANT's control systems. The results showed that technological deficiencies and the lack of internal control at the ANT led to violations of the principle of legal certainty, affecting citizens who relied on the information issued by this entity. It was determined that the notaries public, although they acted in accordance with the available official information, faced difficulties in being unable to independently verify the authenticity of the data. The study also highlighted the need to strengthen interoperability between institutions, ensure ongoing training for notarial staff, and modernize the registry system's technology. As proposals for improvement, the implementation of distributed ledger technologies (DLT), a double-checking system (maker-checker), and the promotion of an institutional culture based on ethics and transparency were proposed. In conclusion, it was established that strengthening oversight and digitalization mechanisms within the ANT is essential to guarantee citizen trust and the effectiveness of the notarial service.
