Abstract

This article investigates the philological and philosophical foundations of the right to housing as a personality right, proposing to overcome the interpretative deficit of conceptualising it exclusively as a provision-based social right. The core problematic lies in the fact that the modern legal tradition disregards the ontological dimension of dwelling and its constitutive function concerning human identity. The objective is to substantiate housing as a category of subjective constitution. The methodology is qualitative and theoretical-bibliographical, employing a hermeneutical and interdisciplinary approach that articulates biblical philology, pre-Socratic philosophy, and legal dogmatics. The findings demonstrate that the analysis of the Greek semantic field of habitation in the New Testament, alongside the thought of Heraclitus and Arendt, reveals that dwelling constitutes, within the Western tradition, an ontological and relational act inextricably linked to the forging of character. It is concluded that dwelling is a constitutive category of the human person. Consequently, comprehensive legal protection demands the recognition of the abode as a strictly personal right, the violation of which is not merely material, but simultaneously compromises all other aspects of human dignity.
